Copyright Policy and DMCA Notices
MyoMed Prep LLC (“Company,” “we,” “us”) respects copyright. We have designated an agent with the United States Copyright Office to receive notifications of claimed infringement, as 17 U.S.C. Section 512(c)(2) requires. We respond to properly submitted notices concerning material stored on our systems at the direction of a user, and we terminate the accounts of repeat infringers in appropriate circumstances.
1. Designated Agent
Notices of claimed copyright infringement must be sent to our designated agent:
Agent: Copyright Agent, MyoMed Prep LLC Address: 1827 11th Ave, Unit #2170, Helena, Montana 59601, United States Email: contact.admin@myomedprep.org (please put “DMCA notice” in the subject line) Copyright Office Registration: DMCA-1079859, registered and active in the U.S. Copyright Office Directory of Designated Agents, where these details can be independently verified.
Email is the fastest route and the one we monitor. This contact is for copyright notices only. Support, billing, and privacy requests sent here will be redirected and delayed.
2. What a Notice Must Contain
To be effective under 17 U.S.C. Section 512(c)(3), your written notice must include substantially all of the following:
2.1 A physical or electronic signature of the copyright owner, or a person authorized to act on the owner’s behalf.
2.2 Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of them.
2.3 Identification of the material claimed to be infringing and information reasonably sufficient to let us locate it. A direct URL is best; “somewhere in your question bank” is not sufficient and we will need to follow up with you for clarification.
2.4 Information reasonably sufficient to let us contact you: address, telephone number, and email address.
2.5 A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
2.6 A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
3. How We Process a Notice
3.1 Review. On receipt of a notice that substantially complies with Section 2, we will review it promptly.
3.2 Removal or Disabling. If the notice is facially compliant, we will remove or disable access to the identified material expeditiously.
3.3 Notification to User. We will take reasonable steps to notify the user who provided the material, and we will give that user a copy of the notice (with the complainant’s personal contact information redacted to the extent permitted by law).
3.4 Restoration After Counter-Notification. If we receive a valid counter-notification under Section 4 and the complaining party does not notify us within ten (10) business days that it has filed an action seeking a court order to restrain the user’s use of the material, we may restore the material in not less than ten (10) and not more than fourteen (14) business days after receiving the counter-notification.
3.5 Record-Keeping. We maintain records of all notices, counter-notifications, and actions taken, including the identity of the user account associated with the material, for purposes of administering our repeat-infringer policy.
4. Counter-Notification
If your material was removed and you believe that removal was a mistake or a misidentification, you may send a counter-notification to the designated agent listed in Section 1 containing:
4.1 Your physical or electronic signature.
4.2 Identification of the material that was removed and the location at which it appeared before removal.
4.3 A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4.4 Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, to the jurisdiction of the United States District Court for the District of Montana, and that you will accept service of process from the complaining party or its agent.
5. Misrepresentation Warning
Under 17 U.S.C. Section 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Both a notice and a counter-notification are sworn statements. If you are unsure whether the use you are complaining about is infringing (fair use, for example, is a right, not an exception you need our permission to exercise), seek legal advice before filing.
6. Repeat-Infringer Policy
6.1 Policy. We maintain and reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.
6.2 Strike System. We operate a three-strike system:
- First Strike. Upon a first confirmed infringement (a notice for which no successful counter-notification is filed), the user receives a written warning and the infringing material is removed.
- Second Strike. Upon a second confirmed infringement, the user receives a final warning, the infringing material is removed, and the user’s ability to upload or submit content may be restricted.
- Third Strike. Upon a third confirmed infringement, the user’s account is terminated. Termination under this section is permanent and without refund.
6.3 Accelerated Termination. We reserve the right to terminate an account after fewer than three strikes when, in our reasonable judgment, the infringement is egregious, willful, or commercial in nature.
6.4 Counter-Notification Reset. A strike is removed if the user files a valid counter-notification and the complaining party does not file suit within the statutory period.
6.5 Pending Claims. We may suspend an account while a claim is being resolved, including during the counter-notification waiting period, if we believe continued access poses a risk of further infringement.
7. Safe Harbor
Company claims the protections available to service providers under 17 U.S.C. Section 512 for material stored at the direction of users. This Policy constitutes the notice-and-takedown and repeat-infringer procedures required by that section.
8. Subpoenas
If we receive a valid subpoena under 17 U.S.C. Section 512(h) seeking identification of a user alleged to be an infringer, we will comply as required by law. We will notify the affected user before disclosing identifying information to the extent permitted by law and will provide the user a reasonable opportunity to seek a protective order or other appropriate relief.
9. Our Own Content
Separately from the above: the lessons, question banks, case studies, simulations, rationales, cheat sheets, imaging interpretation content, and software on the Platforms are original works owned by MyoMed Prep LLC or used under license, and are protected by U.S. and international copyright law.

9.2 Prohibited Use. You may not copy, scrape, redistribute, republish, sell, create derivative works from, or commercially exploit Platform content without our prior written permission. Unauthorized use may result in account termination, claims for damages, and statutory damages under 17 U.S.C. Section 504.
9.3 Enforcement. We actively monitor for unauthorized reproduction of our content and will pursue legal remedies against infringers, including injunctive relief and damages.
